Terms of Service

These Terms of Service ("Terms") govern your access to and use of the proxy bandwidth services provided by DankProxies.com ("DankProxies", "we", "us"). By creating an account, purchasing a plan, or using the service, you agree to these Terms.

1. The service

DankProxies resells proxy network bandwidth. We provide account credentials that route your requests through proxy networks operated by our upstream suppliers, together with a dashboard, usage metering, and an API for managing your account. We do not operate the underlying IP pool.

2. Eligibility and account registration

  • You must be at least 18 years old and able to form a binding contract.
  • You must provide accurate business and contact information, and keep it current.
  • We may require identity or business verification before activating an account, and may decline or suspend any account at our discretion.
  • You are responsible for all activity under your account and for keeping your credentials and API keys confidential.

3. Acceptable use

Your use of the service is governed by our Acceptable Use Policy, which forms part of these Terms. You must accept the AUP before any plan is activated. Violation of the AUP is grounds for immediate suspension or termination without refund.

4. Plans

We offer two kinds of plan. Which one you have is shown on your dashboard and on the plan's page at checkout.

  • Dedicated-IP plans (ISP and datacenter). You are allocated a fixed number of dedicated IP addresses for each monthly billing period, with unlimited bandwidth. There is no gigabyte quota and no usage metering. The IPs remain assigned to you for the paid period; if the plan is not renewed, the allocation ends at the period's close.
  • Metered bandwidth plans (residential and metered datacenter). Each plan includes a stated bandwidth quota, in gigabytes, for each monthly billing period. Consumption is measured by our upstream suppliers and reported to your dashboard; because that reporting is periodic, displayed usage may lag actual usage by a short interval. When the quota is exhausted, service is suspended until the next billing period, until you purchase additional bandwidth, or until auto-replenish (if enabled) tops up your balance. Unused quota does not carry forward unless the plan says otherwise; separately purchased top-up bandwidth does carry forward.

5. Fees and billing

  • Plans are billed monthly in advance in US dollars. Prices are listed on our website and shown at checkout before you purchase.
  • Payments are processed by Stripe. We do not store your full payment card details on our systems.
  • Subscriptions renew automatically each month until cancelled. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period.
  • If a payment fails, we may suspend service until payment is resolved.
  • We may change prices with at least 30 days' notice. Price changes do not affect the billing period already paid for.
  • Refunds are governed by our Refund Policy.

6. Service availability

We aim for high availability but do not guarantee uninterrupted service. The service depends on upstream proxy networks and on the public internet, and may be affected by maintenance, upstream outages, or factors outside our control. Individual IP addresses may be blocked or rate-limited by the sites you access; this is inherent to proxy services and is not a service defect.

7. Suspension and termination

We may suspend or terminate your account, with or without notice, if you breach these Terms or the AUP, if we are required to do so by law or by an upstream supplier, if your payment fails, or if we reasonably believe your use poses a risk to us, our suppliers, or third parties. You may close your account at any time. On termination, your right to use the service ends immediately.

8. Your responsibilities

You are solely responsible for what you do with the service, including ensuring that your activities comply with all applicable laws, the terms of service of any website you access, and any data protection obligations that apply to data you collect. You agree to indemnify us against claims arising from your use of the service.

9. Disclaimers and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue or data.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or through the dashboard at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules. The state and federal courts located in Texas have exclusive jurisdiction over any dispute arising from these Terms.
